Who these terms cover
Caffeine Media is the trading name of Toby Jones, a sole trader based in Blackpool, UK. These terms apply whenever you engage Caffeine Media for video editing, stereo conversion, restoration, screenwriting, corporate video, music video, drama, live streaming or any other service listed on this site. Using this website, or asking for a quote, means you accept these terms; a written agreement or email confirming a specific project takes priority over this page where the two differ.
Quotes and scope
Costs quoted before a project starts are estimates based on the scope you describe. If the scope changes materially once work is underway - extra footage, additional revision rounds beyond what was agreed, a later deadline that requires rush turnaround - the cost and schedule may be revised, and you'll be told before extra work is carried out.
Payment
Unless otherwise agreed in writing, a deposit is payable before work begins on larger projects, with the balance due on delivery. Invoices are payable within 14 days of the date issued. Work may be paused, and final files withheld, if payment is significantly overdue.
Your materials
You're responsible for making sure you have the rights to any footage, photos, music, tapes or other material you provide, and for keeping your own backup copies before sending anything over. Physical media (tapes, film reels, drives) is handled carefully, but Caffeine Media isn't liable for pre-existing damage, degradation or loss present before the material was received.
Revisions
Most projects include an agreed number of revision rounds, set out in the quote or written agreement for that job. Revisions beyond that number, or changes that go beyond the original brief, may be charged separately.
Ownership and usage rights
Once a project is paid in full, you own the final delivered work for the purpose it was made for. Caffeine Media retains the right to keep project files for a reasonable archive period and to show the finished work (not unreleased drafts) in a portfolio, unless you've asked in writing for it to be kept private - which is always honoured for sensitive work such as funeral live streams.
Cancellation
You can cancel a project at any time before delivery. Work already completed is chargeable at the agreed rate, and any deposit paid is non-refundable where work has already begun, except where Caffeine Media is unable to complete the project.
Liability
Caffeine Media takes reasonable care with every project, but liability for any single job is limited to the amount paid for that job. Caffeine Media isn't liable for losses caused by inaccurate information you provide, delays outside its reasonable control, or third-party services (such as App Store payments, GitHub Pages hosting, or a streaming platform's own outage).
Live streaming
For live-streamed events (funerals, weddings and similar), every reasonable effort is made to ensure a stable stream and a recording, but live streaming depends on venue connectivity that's outside Caffeine Media's control. Where a stream is disrupted by circumstances beyond reasonable control, a recording of the event is still provided where possible.
Governing law
These terms are governed by the law of England and Wales, and any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these terms
This page may be updated from time to time to reflect how Caffeine Media actually operates. The terms that applied when a project was agreed are the ones that apply to that project.
